Purchasing via Paddle

For our online sales, we rely on Paddle to act as our Merchant of Record. When you purchase our product, they handle the checkout process, including payment processing, fraud detection, handling of taxes, and compliance with local laws and regulations. Once Paddle authorizes payment for our product, it establishes a direct, secure connection to our server so we can process the order and return a download link and generated product license key. Via this connection we receive your email address, along with non-personal information such as country of purchase, price paid, and quantity ordered. We do not receive payment details such as your credit card number, nor do we have access to that information via Paddle’s vendor interface. We also receive the state of the Paddle opt-in checkbox which asks if you’d like to receive product updates and offers from us via email. This option is unchecked by default and is completely optional. If you do opt-in, it is possible to opt-out at any time. When you make a purchase we collect and store the following information:

  • Your name, email address and product license key, which are considered personal information as they uniquely identify you.
  • Your email address is also stored in a separate mailing list table, if you opted-in to our mailing list. We use the information we collect for the following:
  • Your email address and license key are used so we can retrieve lost license keys, to verify purchases, and to send product updates.

Fair Use Policy

Our Cloud products (APIs, SaaS) are used concurrently by a number of subscribers. If a single customer places very high demands on the service, then it is possible that this will affect the experience for other users. Our Fair Use Policy monitors and manages inappropriate use automatically, making sure the service can be used fairly by everyone. Only customers that consistently generate exceptionally high load over a sustained period of time will be limited or temporarily blocked by these automated rules.

Services and Products are Available “AS-IS”

Your access to and use of the Services, Products or any Content are at your own risk. You understand and agree that the Services and Products are provided to you on an “AS IS” and “AS AVAILABLE” basis. The “Interactive32 Entities” refers to Interactive32, its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors. Without limiting the foregoing, to the maximum extent permitted under applicable law, THE INTERACTIVE32 ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. The Interactive32 Entities make no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of the Services, Products or any Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services, Products or any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Services; and (iv) whether the Services or Products will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from the Interactive32 Entities or through the Services, will create any warranty or representation not expressly made herein.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE INTERACTIVE32 ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES OR PRODUCTS; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES AND, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE INTERACTIVE32 ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Changes to these terms may be made at any time. Changes will become effective immediately upon changes to this website. Viewers may check this website at anytime to be up to date.
